THECOMMISSIONOFTHEEUROPEANCOMMUNITIES,

HavingCommunity,

regardtotheTreatyestablishingtheEuropeanHaving1987regardtoCouncilDirective88/77/EECofrelatingongaseoustothetheapproximationmeasurestoofbethetakenlawsagainstofthe3DecembertheMemberemissionStatesenginestantsliquefiedfromforandpositive-ignitionuseparticulateinvehicles,pollutantsandfromcompression-ignitionofenginestheemissionfuelledofgaseouspollu-bytheDirectivepetroleumCouncil(21999/96/ECgasfor),andinparticularofusetheinEuropeanvehicles(with1),asnaturallastamendedgasorArticle4Parliamentthereof,andofWhereas:

Directiveunder88/77/EECisoneoftheseparateDirectivethetype-approvalapproximation70/156/EECprocedurelaiddownbydirectivesCounciltoofthelawsofof6theFebruary1970onthetrailersthetype-approvalofmotorMembervehiclesStatesandrelatingtheirtheEuropean(3),aslastParliamentamendedandbyDirectiveoftheCouncil2000/40/EC(4).of(2)

Directivecyclesdeviceand1999/96/ECprescriptionsprovidedtopreventfornewtheuseemissiontestnowand/orirrationalemissionscontrolstrategy.ofdefeatItistoenginesprovideappropriateatooltoforstrengthenauthoritiesthoserequirementsandsionsareusingdefeatdevicesand/ortodetermineirrationalwhetheremis-toemissionsmanipulatecontrolstrategiescontrol.

Itenvironmentallyisacceptedthatinbeneficialgasvehiclesalternativecanprovidetodieselarealisticvehiclesandtotermsofairpollutantemissions.Whiletheyareable1999/96/EC,achievethedesign,certainemissiongaslimitsengines,mandatedbyinDirectivevalidityhavedifficultycomplyingwithvirtuethetestofcycletheirenginepowerresponsecriteriawithrespecttotheaccuracyofthegas(ETC).byrespectingTodemandedtoavoidthesettingbythedesignathechangesinspeed,torqueandgasEuropeanfreedomenginedesignTransientphilosophyrequirementCycleofthe

Witheffectfrom1October2001,noMemberStatemay:

(a)refuseprovidedtogrant70/156/EECforinECthetype-approval,lastindentoforArticletoissue10(1)theofdocumentofengine;vehicleorpropelledortograntbynationalacompression-ignitiontype-approvalforDirectiveoratypegas(b)prohibitsuchnewthevehicles;registration,or

sale,entryintoserviceoruseof

(c)refusetograntECtype-approvalforatypeofcompression-ignitionorgasengine;or(d)prohibitthesaleoruseofnewcompression-ignitionorgas

engines,iftheappropriaterequirementsofDirective88/77/EEC,asamendedbythisDirective,aresatisfied.2.

Witheffectfrom1October2001,MemberStates:(a)maynolongergrantECtype-approvalorissuethedocu-mentprovidedforinthelastindentofArticle10(1)ofDirective70/156/EEC,and(b)shallrefusenationaltype-approval

fortypesofcompression-ignitionorgasenginesandtypesofvehiclepropelledbyacompression-ignitionorgasenginewheretherequirementsofDirective88/77/EEC,asamendedbythisDirective,arenotmet.

3.Witheffectfrom1October2001andexceptforvehiclesandenginesintendedforexporttonon-membercountriesandexceptforreplacementenginesforin-servicevehicles,MemberStatesshall:

(a)considercertificatesofconformitywhichaccompanynewvehiclesornewenginespursuanttoDirective70/156/EECasnolongervalidforthepurposeofArticle7(1)ofthatDirective,and(b)prohibittheregistration,saleorentryintoserviceoruseof

newvehiclesandthesaleanduseofnewenginesfortypesofcompression-ignitionenginesandtypesofvehiclepropelledbyacompression-ignitionenginewheretherequire-mentsofDirective88/77/EEC,asamendedbythisDirective,arenotmet.

4.Witheffectfrom1October2003andexceptforvehiclesandenginesintendedforexporttonon-membercountriesandexceptforreplacementenginesforin-servicevehicles,MemberStatesshall:

(a)considercertificatesofconformitywhichaccompanynewvehiclesornewenginespursuanttoDirective70/156/EECasnolongervalidforthepurposeofArticle7(1)ofthatDirective,and(b)prohibittheregistration,saleorentryintoserviceoruseof

newvehiclesandthesaleanduseofnewengines

fortypesofgasenginesandtypesofvehiclepropelledbyagasenginewheretherequirementsofDirective88/77/EEC,asamendedbythisDirective,arenotmet.
